These terms govern your use of the DPIA Assistant Tool at www.dpia.com.my. By using the Tool you accept them. If you do not accept them, please do not use the Tool.
The Tool produces a draft. It is not a completed Data Protection Impact Assessment, and it is not legal advice. Before you rely on anything the Tool produces, it must be reviewed by a qualified data protection professional and approved by an appropriate person in your organisation’s management. If you skip that step, the consequences are yours, not ours.
The Tool is a free productivity aid. It takes information you type in and arranges it into the layout of the DPIA template set out in Annex A of the Data Protection Impact Assessment Guideline (Version 1.0, 30 April 2026) issued by the Personal Data Protection Department, Malaysia.
That is the whole of what it does. In particular, the Tool:
Edwin Lee & Partners operates the Tool. Using the Tool does not make you a client of the firm and does not create a lawyer-client relationship. Such a relationship arises only through a formal engagement, following our usual conflict checks and a signed engagement letter.
Nothing you enter into the Tool is protected by legal professional privilege by reason of your use of the Tool.
Every document the Tool produces is watermarked as a draft and carries a precautionary note. Those markings are part of the document and must not be removed, obscured, or altered.
Before relying on any output, you must:
You must not present, submit, or describe an output of the Tool as a completed Data Protection Impact Assessment, whether to a regulator, a client, a counterparty, an auditor, or anyone else.

The quality of the output depends entirely on the quality of your input. The Tool cannot tell whether what you have typed is right.
You must not:
The Tool is provided free of charge and on an “as is” basis. We do not promise that it will be available at any particular time, that it will be free of errors, or that it will be compatible with your browser or device. We may change, suspend, or withdraw the Tool, in whole or in part, at any time and without notice.
The Tool reflects the DPIA Guideline as at the version and date stated in the output. Guidelines change. We try to keep the Tool current but we do not guarantee that it reflects the latest position at any given moment. You should check the current text of the Guideline yourself.
To the fullest extent permitted by law, we exclude all warranties, conditions, and representations of any kind, whether express or implied, in relation to the Tool and its outputs. This includes any implied warranty of accuracy, completeness, merchantability, fitness for a particular purpose, or compliance with any law or guideline.
To the fullest extent permitted by law, neither Edwin Lee & Partners nor any of its partners, employees, or agents is liable to you or to anyone else for any loss or damage arising out of or in connection with:
Nothing in these terms limits or excludes any liability that cannot lawfully be limited or excluded, including liability for fraud or fraudulent misrepresentation.
The Tool, including its design, question flow, guidance text, and code, belongs to Edwin Lee & Partners. You may use it for its intended purpose. You are not granted any other right in it.
The DPIA Guideline and its Annex A template are the property of the Personal Data Protection Department, Malaysia. The Tool reproduces parts of the template and its guidance notes for the purpose of assisting compliance with the Guideline. We claim no rights in that material.
The draft document the Tool generates from your inputs is yours. You may use, edit, and share it, subject to the requirement in clause 3 that it be reviewed and approved before you rely on it, and subject to the requirement that the watermark and precautionary note remain intact until a qualified reviewer has signed it off.

The Tool links to other websites, including www.dpomalaysia.my and the website of the Personal Data Protection Department. We are not responsible for the content of any external site.
We may update these terms. The version number and date at the top of this page will change when we do. Continuing to use the Tool after a change means you accept the updated terms.
These terms are governed by the laws of Malaysia. The courts of Malaysia have exclusive jurisdiction over any dispute arising out of them or out of your use of the Tool.
